Clearly regulated authority procedure
The competent authority - the Environmental Law Department in the Office of the Lower Austrian Provincial Government - manages the EIA procedure. It sets all deadlines, is responsible for the public requirements in the siting municipalities and in the district administration of Vienna's surrounding area, and also conducts the hearing.
The environmental impact assessment (EIA) is a procedure with public participation. This means that all documents submitted to or prepared by the authority are also made available to the public. This means that anyone who is interested can inspect the documents at precisely defined times.
The Federal Environmental Impact Assessment Act (UVP-G) essentially provides for two opportunities for participation. Every citizen may inspect the project documents, submit written comments on the project and participate in the public discussion and oral hearing. Persons or groups with party status are also entitled to assert their rights in the procedure. For example, they have the right to inspect files and can appeal against the EIA decision up to the highest courts.

The Federal Administrative Court, as appellate instance, rejects the application for the 3rd runway in its decision of 02.02.2017.

The decision of the Federal Administrative Court of 02.02.2017 is annulled as unconstitutional by decision of the Constitutional Court of 29.06.2017 and referred back to the Federal Administrative Court for a new decision.

The BVwG decides again on 23.3.2018 and grants the application for the 3rd runway.

By decisions of 4.10.2018 and 9.10.2018, the VfGH refuses to deal with the submitted appeals.

In its decision of 06.03.2019, the VwGH rejects or dismisses the appeals submitted.
